General Terms and Conditions of Sale

Article 1 – Scope
These General Terms and Conditions of Sale (hereinafter "Terms") govern all sales made through the website theworkshop.jamaisvulgaire.com (hereinafter "the Site"), operated by JamaisVulgaire (hereinafter "the Seller"). Any order placed on the Site implies full and unreserved acceptance of these Terms.
Article 2 – Products
Products offered for sale are those described on the Site at the time of viewing. Photographs and descriptions are as accurate as possible but may not be held against the Seller in case of slight differences. Certain products are made-to-order or made-to-measure by our partner ateliers located in Spain (Almansa) and Vietnam.
Article 3 – Ordering Process
The customer selects the desired products, adds them to the cart, provides delivery details, and proceeds to payment. A confirmation email is sent after payment validation. The order is considered final upon receipt of this email.
Article 4 – Prices
Prices are displayed in euros, inclusive of all taxes. The Seller reserves the right to modify prices at any time. Products are invoiced at the price in effect at the time of order validation. Shipping costs, if applicable, are indicated before payment validation.
Article 5 – Payment
Payment is made online at the time of ordering. Accepted payment methods are:
- Credit card via Stripe (Visa, Mastercard, American Express)
- PayPal
- Alma (pay in 2, 3, or 4 installments, subject to eligibility)
Payment is secured by SSL encryption. The Seller does not store any banking data; processing is entirely handled by payment providers.
Article 6 – Delivery
As products are made-to-order, production times vary:
- Express production: approximately 1 week
- Standard production: 3 to 5 weeks
Shipping is done directly from the producing atelier. Delivery to mainland France and Europe is free. A tracking number is sent by email upon shipment. Stated timeframes are estimates. A delay does not constitute grounds for order cancellation unless it exceeds 30 days beyond the announced timeframe.
Article 7 – Right of Withdrawal
In accordance with Articles L.221-18 et seq. of the French Consumer Code, the customer has 14 calendar days from receipt of the product to exercise the right of withdrawal, without needing to provide a reason.
Exceptions: pursuant to Article L.221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for products made-to-measure or clearly customized to the customer's specifications. Made-to-measure orders are therefore excluded from the right of withdrawal.
For standard-size products, the customer must notify their decision by email to contact@jamaisvulgaire.com. The product must be returned in its original condition, unworn, with all packaging elements. Refund is processed within 14 days of receiving the return.
Article 8 – Returns and Exchanges
Returns are free for mainland France and Europe. A prepaid return label is provided upon request. In case of a confirmed manufacturing defect, the Seller covers repair or replacement of the product.
Article 9 – Warranty
All products benefit from the legal warranty of conformity (Articles L.217-4 et seq. of the Consumer Code) and the warranty against hidden defects (Articles 1641 et seq. of the Civil Code). In case of a conformity defect noted within 2 years of delivery, the customer may request repair, replacement, or, failing that, a refund.
Article 10 – Liability
The Seller shall not be held liable for failure to perform the contract in case of force majeure, disruption or strike of postal or transport services, flood, fire, or any event beyond its control. The Seller's liability is limited to the amount of the order concerned.
Article 11 – Intellectual Property
All content on the Site (text, visuals, logos, trademarks, photographs, illustrations) is the exclusive property of JamaisVulgaire or its partners. Any reproduction, even partial, is prohibited without prior written authorization.
Article 12 – Applicable Law and Disputes
These Terms are governed by French law. In case of dispute, the parties shall seek an amicable solution. Failing that, the dispute shall be brought before the competent courts of the Seller's registered office. In accordance with Article L.612-1 of the Consumer Code, the customer may use a consumer mediator free of charge for amicable dispute resolution.
